Destiny Media Responds to Press Release from Canadian Competitor

VANCOUVER, September 21, 2009  --  Destiny Media Technologies, Inc. (DSNY OTCBB) announces that it has filed a statement of defense and counterclaim against Yangaroo (YOO-TSX, YOOIF-PK) in the U.S. patent infringement lawsuit brought by Yangaroo.  Destiny believes that Yangaroo's case in the U.S. is without merit and will oppose it vigorously.  Destiny believes that Yangaroo's press releases are exaggerated and to imply that it has won an "injunction case" when the court has not issued an injunction is misleading. The case has just begun and there is no motion for a preliminary injunction before the court.

Amongst Destiny's several defenses are that Destiny's system simply does not operate the same way that Yangaroo's patent claims call for and that Destiny's technology dates back to well over a year prior to their patent filing dates. Destiny also believes that bringing this case is highly improper as the relevant Destiny computer systems reside outside the borders of the U.S.. It appears that the case was brought despite the fact that Yangaroo was aware of this as a result of the related Canadian litigation.   If Destiny prevails, it will seek its costs in this litigation from Yangaroo.
